GERC /APTEL:
The matter involved a Petition filed by Gujarat Urja Vikas Nigam Limited (a bulk purchaser of solar power) seeking downward revision of solar tariffs which were fixed by the GERC by way of a generic tariff order in the year 2010 for a period of 25 years. Apart from the issue of maintainability, the matter also involved the jurisdiction of the GERC in regulating the tariff and re-opening of concluded Power Purchase Agreements (PPAs) based on such generic tariff order. The Petitioner had sought re-opening of the concluded PPAs and re-determination of the tariff on the ground of general public interest. The matter was of extreme significance since re- opening of the generic tariff order passed in 2010 would have impacted more than 75 solar power project developers who had set up their solar projects in Gujarat pursuant thereto and invested more than Rs.8000/- crores. Anirban successfully argued the matter before the Gujarat State Electricity Commission. The Government company having lost the first round filed an appeal before the Energy Tribunal, APTEL. Anirban again argued and won.
IPCL BEFORE WBERC/ORISSA HIGH COURT
Anirban represented its client before the Orissa High Court in a writ petition challenging the award of licence under Section 20 of the Electricity Act. Anirban is representing its client before WBERC in tariff related issues including for drawing up relevant regulations for collection of electricity charges from switch over consumers
MAHINDRA CIE
Anirban is presently representing Mahindra against MSEDCL before the APTEL in a dispute pertaining to levy of surcharges against it due to determination by MERC that his Client is not a Captive Generating Plant.
UTTAM GALVA
Anirban is currently arguing an appeal before Supreme Court whereby he is contesting the determination by APTEL that his client is a TSU.
